1. Custom/Made-to-Order Products
All prints sold through Archive-35 are custom, made-to-order products. Each print is produced specifically for you after your order is placed. Production begins immediately upon payment confirmation.
Due to the custom nature of these products, the Consumer Protection (Distance Selling) Regulations right to cancellation does not apply.
2. All Sales Final — No Returns or Refunds
All sales are final. Because each print is custom-produced to your specifications, we cannot accept returns or issue refunds for:
- Change of mind or buyer's remorse
- Color variations due to monitor calibration differences
- Size dissatisfaction (dimensions are clearly listed at time of purchase)
- Incorrect size or product selection by customer
3. Damaged Shipments — The Only Exception
If your print arrives damaged during shipping, we will replace it at no charge. To qualify for a replacement:
- Notify us within 48 hours of delivery via our contact form
- Provide photographs of the damage AND the original packaging
- Do not discard the packaging until the claim is resolved
- Damage must be shipping-related, not handling damage after delivery
We reserve the right to deny claims that do not meet these requirements.
4. Color & Display Disclaimer
Images displayed on this website are for reference only. Actual print colors may vary from what you see on your screen due to:
- Monitor calibration and color profile differences
- Ambient lighting conditions when viewing your screen
- Display technology variations (LCD, OLED, etc.)
- Print substrate characteristics (canvas texture, metal sheen, etc.)
We use professional color management in our printing process, but slight variations are normal and expected. Color variation is not grounds for a refund.
5. Production & Delivery Times
All prints are handcrafted by our professional print partner. Typical production times:
- Canvas prints: 5-7 business days
- Fine Art Paper prints: 5-7 business days
- Metal prints: 10-14 business days
- Acrylic prints: 10-14 business days
- Wood prints: 10-14 business days
Shipping: Free ground shipping to USA and Canada (5-9 additional business days). International shipping available upon request.
Total delivery time: Please allow 2-4 weeks from order to arrival. Production and shipping times are estimates and not guaranteed. Delays may occur due to high demand, holidays, or circumstances beyond our control.
6. Copyright & Usage Rights
All images displayed on this website and sold as prints are copyrighted by Archive-35 and/or Wolf Schram. Purchase of a print grants you the following limited rights:
- Personal display: You may display the physical print in your home or office for personal, non-commercial enjoyment.
You may NOT:
- Reproduce, scan, or photograph the print for reproduction purposes
- Create derivative works from the print
- Use the image for commercial purposes without a separate license
- Resell digital copies or reproductions of the image
- Claim ownership of the underlying photograph
Commercial licensing is available separately. Please contact us for licensing inquiries.
7. Payment & Security
All payments are processed securely through Stripe. We do not store your credit card information. By completing a purchase, you authorize us to charge your payment method for the total amount shown at checkout.
Prices are in US Dollars (USD) and include free shipping to USA and Canada. International orders may incur additional shipping charges.
8. Limitation of Liability
Archive-35's maximum liability for any claim related to your purchase shall not exceed the purchase price you paid for the specific item in question.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Lost profits or revenue
- Loss of data or information
- Emotional distress
- Delays in delivery
- Any damages arising from circumstances beyond our reasonable control
9. Dispute Resolution
If you have a concern about your order, please contact us first through our contact form. We will make reasonable efforts to resolve any issues. Any disputes that cannot be resolved informally shall be subject to the laws of the State of Texas, United States.
10. Modifications to Terms
We reserve the right to modify these Terms of Sale at any time. Changes will be effective immediately upon posting to this page. Your continued use of our website and services after changes are posted constitutes acceptance of the modified terms.
11. Agreement
By completing your purchase, you acknowledge that you have read, understood, and agree to these Terms of Sale in their entirety. Your payment and acceptance of the Terms checkbox at checkout constitutes a binding agreement to these terms.
